Terms of Service

Fractiks finds and enriches sales leads, drafts outreach, sends emails from your own connected mailbox, and queues calls. It is a business tool for business users; you must be at least 18 and using it on behalf of a business.

You are responsible for your account credentials and for everything done under your workspace. Keep your password secure and tell us promptly at david.sal@mindlace.co.uk if you suspect unauthorised access.

Lead enrichment runs on prepaid credits sold in packs (prices on the pricing page). One credit is spent only when an enrichment actually reveals a verified email address for a lead; attempts that reveal nothing are not charged. Credits do not expire, are not transferable between workspaces, and have no cash value beyond the refund right below. Payment is processed by Stripe; we never hold your card details.

The email-warmup add-on is a monthly subscription per mailbox, billed by Stripe until you cancel. Cancelling takes effect at the end of the paid period and stops warmup for that mailbox.

Unspent credits from a pack are refundable on request within 14 days of purchase — email david.sal@mindlace.co.uk. Credits already spent on completed enrichments are not refundable. Warmup subscription fees for the current period are not refunded on cancellation; you simply keep the service until the period ends.

You send outreach from your own mailbox to prospects you choose. You are solely responsible for that outreach complying with the laws that apply to you and your recipients — including UK GDPR and PECR, the EU GDPR and ePrivacy rules, and CAN-SPAM — and for honouring opt-outs. Do not use Fractiks to send unlawful, deceptive, or harassing messages, and do not use it to contact individuals where you have no lawful basis to do so. We may suspend accounts whose sending patterns put the platform or other users at risk.

The service depends on third parties: lead data providers, payment processing (Stripe), email warmup infrastructure (Instantly), and your own email provider (e.g. Google). Their availability is outside our control; where a provider changes or withdraws a capability we will make reasonable efforts to substitute or notify you.

The service is provided “as is”. Lead data is compiled from third-party sources and is not guaranteed accurate or current. We do not guarantee deliverability, reply rates, or business outcomes. To the maximum extent permitted by law, our total liability arising out of the service in any 12-month period is limited to the amounts you paid us in that period, and neither party is liable for indirect or consequential loss. Nothing in these terms excludes liability that cannot lawfully be excluded.

You can stop using the service at any time; contact us to close your workspace. We may suspend or terminate accounts that materially breach these terms. On closure, unspent credits are handled per the refunds section above.

We may update these terms; material changes will be notified in-app or by email, and continued use after the effective date is acceptance. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
